At FGKS Law, we understand that a car accident can be a life-altering event, causing physical, emotional, and financial distress. Our personal injury attorneys are dedicated to providing the expert legal representation you need to navigate the complexities of car accident claims and secure the compensation to which you are entitled.

Comprehensive Legal Services for Car Accident Victims

FGKS Law offers a full range of services tailored to address the unique challenges of car accident cases. We assist our clients in finding all applicable insurance coverages, including underinsured motorist provisions and umbrella policies, ensuring that you receive maximum compensation for your injuries and losses. When appropriate, we retain accident reconstructionists and other experts, including physicians to sender opinions regarding your injuries, causation, and permanent impairment.

Insurance Coverage and Compensation

Our attorneys are skilled in identifying all sources of insurance coverage. This includes:

  • At-Fault Party and Related Coverages: Depending on the owner of the truck or car, whether the driver was in the scope of his/her employment, and other factors, there may be additional auto insurance policies available to pay your personal injury settlement.
  • Underinsured Motorist Provisions: We help you tap into your underinsured motorist coverage when the at-fault party’s insurance is insufficient to cover your damages.
  • Umbrella Policies: We explore additional coverage available on umbrella policies that may provide further compensation beyond typical auto insurance limits.

Support in Criminal Proceedings

If the at-fault party faces criminal charges, FGKS Law assists you as a victim throughout the criminal process. We can help with:

  • Victim Impact Statements: Providing guidance on crafting compelling victim impact statements to present in court.
  • Meetings with the Prosecutor: Assisting in meetings with the prosecutor to ensure your voice is heard and your interests are represented.

Healthcare Provider Coordination

Medical care is a critical component of your recovery. We support our clients by:

  • Letters of Protection: Issuing letters of protection to healthcare providers, if necessary, ensuring they receive payment from your personal injury settlement and allowing you to receive necessary medical treatment without immediate out-of-pocket costs. This allows you to avoid damage to your credit rating, litigation to collect on past due accounts, and accumulation of interest on balances due.
  • Medical Bill Payment: Assisting with the payment of medical bills through the medical payment provisions of your auto insurance policy, alleviating financial pressure while you recover.

Injury Attorney Fee Agreements

FGKS Law usually handles injury cases on a contingent fee basis but can pursue cases on an hourly rate basis if preferred. Unlike other firms, we do not subscribe to a one-size-fits-all, high-volume approach. FGKS Law will evaluate your case individually and at no charge to you. All consultations are confidential and protected from disclosure by the attorney-client privilege. Only after the evaluation will we determine an appropriate fee arrangement for your case. You will never be pressured into executing a fee agreement. All fee agreements are in writing, signed by you and our firm.

Frequently Asked Questions on Car Accident Services

Immediately after a car accident, ensure your safety and the safety of others. Call 911 to report the accident and seek medical attention, even if you feel fine. Document the scene by taking photos, gathering witness contact information, and exchanging details with the other driver. Avoid making statements about fault. In the days following a crash, you may be asked to sign certain documents or give a tape-recorded statement. Do not do so without speaking to us first.

Uninsured/underinsured motorist coverage (UIM) protects you when the at-fault driver either has no insurance or not enough insurance to cover your damages. It provides additional compensation for medical expenses, lost wages, and other damages. UIM is crucial because many drivers carry only the minimum required liability insurance, which may not be enough to fully compensate you for serious injuries, or your death.

After a car accident, you may receive many unsolicited mailings from law firms seeking to represent you. It’s important to ignore these aggressive solicitations and instead choose a law firm based on reputation, referrals, and your comfort level with the attorney. FGKS Law relies on our established reputation and client referrals rather than aggressive marketing tactics. Contact us directly to discuss your case and receive personalized, trustworthy legal advice.

A contingency fee agreement means you don’t pay any upfront fees for legal representation. Instead, your attorney’s fees are contingent prevailing in your case through either trial or settlement. FGKS Law only gets paid if we secure a settlement or jury award for you. This arrangement allows you to access high-quality legal services without financial stress.

A police report that cites the at-fault party is crucial evidence in your car accident claim. It provides an official record of the accident, the parties involved, and the citation issued to the at-fault driver. A subsequently guilty plea or payment of the citation can establish liability, which is essential for negotiating with insurance companies.

In Ohio, non-economic damages, such as pain and suffering, are capped at $250,000 or three times the economic damages, whichever is greater, up to a maximum of $350,000 per plaintiff and $500,000 per occurrence. For catastrophic injuries, such as permanent and substantial physical deformity or loss of a bodily organ system, the cap may not apply. There are no monetary limits on economic damages, such as medical bills, past and future lost wages, property damages, etc. There are no limits on compensable damages in any wrongful death claims.

If the at-fault driver’s insurance is insufficient, you can file a claim with your own insurance company under your underinsured motorist (UIM) coverage. UIM coverage provides additional compensation for your uninsured medical expenses, lost wages, and other damages. This area of the law can be complicated, and it is important to review your policy and consult with an attorney to maximize your recovery.
